Data Protection & Privacy

India's data protection framework and the quantum threat to encryption are converging on the same question: is your organisation's security posture "reasonable" not just today, but for as long as the data needs to stay confidential?

DPDP Act Compliance

Building compliance programmes aligned to India's Digital Personal Data Protection Act and its phased Rules — from notice and consent design through Data Protection Board readiness.

Cross-Border Data Transfers

Advising on the conditions and restrictions governing transfer of personal data outside India, including obligations specific to Significant Data Fiduciaries.

Data Localization

Advising on sector-specific data localisation requirements relevant to quantum-adjacent infrastructure, including financial and critical-infrastructure data.

Privacy Impact Assessments

Conducting privacy impact assessments for organisations processing sensitive personal data, with quantum-era retention and encryption risk built into the methodology.

Sensitive Data Governance

Structuring governance frameworks for the categories of data — health, financial, biometric, government — that carry the greatest long-term confidentiality risk.

Data-Retention Policies

Designing retention and deletion policies that reduce "harvest now, decrypt later" exposure by ensuring an organisation is not holding more long-lived sensitive data than it needs to.

Quantum Risks to Encrypted Data

Advising on how quantum-era decryption risk should inform an organisation's data protection impact assessments, security safeguard documentation, and encryption migration roadmap.

Regulatory Timeline

Where DPDP compliance stands.

India's DPDP Rules took effect on a staged basis: initial provisions — including constitution of the Data Protection Board of India — took effect immediately upon notification, consent-manager provisions follow roughly a year later, and the remaining substantive compliance obligations become effective on an 18-month runway from notification. Organisations still treating 2026 as early preparation time should move to active implementation.
